Working at Height in Malaysia: Navigating DOSH Guidelines, CDM 2024, and Future Safety Regulations

Are you compliant with Malaysia’s new Working at Height regulations? Discover how OSHA 2022 and CDM Regulations 2024 impact your site safety. Get expert WAH training and consultancy from Perintis OSH today.

If you manage a construction site or facility in Malaysia, the rules for Working at Height (WAH) are shifting beneath your feet. For decades, safety officers relied on the DOSH Guidelines for the Prevention of Falls at Workplaces (2007).

While these guidelines remain the technical “bible” for many, the legal landscape has drastically changed with the enforcement of the OSHA Amendment Act 2022 and the new CDM Regulations 2024.

Here I’ve broken down exactly what these changes mean for your business and how Perintis OSH (Perintosh) can help you stay compliant and accident-free.

The Old Way of Thinking (2007 Guidelines)

The New “Duty of Care”: It’s Not Just About the Contractor Anymore

Effective June 1, 2024, the Occupational Safety and Health (Construction Work) (Design and Management) Regulations 2024 (CDM) revolutionized liability.

The Old Way: If a worker fell, the blame often rested solely on the contractor for failing to provide a harness or guardrail.

The New Way: Responsibility now extends to the Client and Designers. If a building is designed without safe access points for maintenance (e.g., no anchor points for window cleaners), the client and architect can be held liable for WAH accidents.

Future-Proofing: The “Draft” WAH Regulations

DOSH (JKKP) has been reviewing specific Work at Height Regulations to replace general guidelines. While currently in the draft stage, industry best practices are already moving in this direction.

Risk Over Height: The industry is moving away from the strict “2-meter rule.” The new standard is Risk-Based—if a fall from any height could cause injury, protection is mandatory.

Rescue Plans: Calling “999” is no longer an acceptable rescue plan. You must have on-site capability to rescue a suspended worker immediately to prevent suspension trauma.

How Perintis OSH (Perintosh) Can Assist You

What we cover: Correct use of fall arrest systems, practical climbing techniques, and crucial self-rescue procedures.

Target Audience: General workers, supervisors, and safety officers.

2. Strategic Safety Consultancy & Audits

CDM Compliance: We assist clients and principal contractors in setting up the required Design Risk Management frameworks to eliminate WAH risks before construction even begins.

HIRARC Review: We help you update your Hazard Identification, Risk Assessment, and Risk Control (HIRARC) documents to reflect the latest legal penalties and duty structures.

Don’t Wait for an Accident to Upgrade Your Safety

The cost of non-compliance under the new OSHA Act has increased significantly (up to RM500,000 in fines). Investing in proper training and consultancy is not just a legal defense—it’s a moral imperative.
